Breaking News: Pension Increased of PTCL Pensioners: PTET Issued Notification

A notification has been issued by the Director (Pension) PTET Lahore regarding pension increased on the following rates on dated 27-1-2011.
Pensioners retired before 1996    =  20% increase
Pensioners retired after 1996         = 8%
The effective date is 01-07-2010
Letter has been issued to the all Post Offices for increase in pension.

    VIOLATION OF FEDERAL GOVERNMENT’S GUARANTEED PENSIONARY BENEFITS OF TRANSFERRED EMPLOYEES RETIRED FROM PTCL

    Respected Sir,

    I would like to draw your kind attention towards gross injustices committed by Chairman Board of Trustees Pakistan Telecommunication Employees Trust towards a very poor segment of the Society getting Pension from the Trust as per their entitlement which has been curtailed unlawfully for which Standing Committee of National Assembly has taken serious notice and matter is on their Agenda for redressal.

    As you well aware that the Board of Trustees of Pakistan Telecommunication Employees Trust has cut down “beneficial interest” of the beneficiaries unlawfully by putting retired Transferred employees in different categories for the purpose of increase pension and issued order on 27th January,2011 allowed as 20% and 8% without Medical Allowance in two categories and allowed unjustified 75% Family Pension up to December,1995 instead of December,2000 and that too has been paid after the lapse of 7 month, being a Pensioner whose pensisonary benefits has been curtailed to the extent of 8 % and the position explained and stance taken by the Secretary I.T. & Telecom Division, Ministry of Information Technology before Standing Committee of National Assembly’s meeting held on 15th March,2011 for the betterment of PTCL Pensioners depict a gloomy picture of the employees retired from PTCL as Transferred Employee

    Secretary informed the Committee that the employee retired before January,1996, were considered as Government Servants whereas the employees retired after the Company became Corporation are considered as Corporation employees, therefore employees retired in Second category cannot be taken into the domain of retired Servants of T&T . He said they have been given an increase of 8 percent. He accepted ambiguities in categories and seek time for thorough study and legal opinion of the matter.     That the point of view and stance taken by the Secretary is not based on law as under Section 46 (b) and (c) PTCL legally bound to own accrued pension liabilities and contribute amount at the commencement of each financial year to (PTET).

    Under Section 46 (d) PTET shall make provision for the payment of Pensions to telecommunication employees to the extent of their entitlement.

    According to definition employees transferred from PTC to PTA, NTC, FAB, and PTET considered as telecommunication employees and in PTCL defined as transferred employees who are receiving or are entitled to receive pensionary benefits in T&T, PTC.
    VIOLATION OF GUARANTEED PENSIONARY BENEFITS

    Section 59 (2) of the Pakistan Telecommunication (Re-Organization) Act.1996 protected the Regulations framed under PTC Act.1991 and keeps rights of employees intact as Rights once granted to the transferred employees remain protected and change of ownership does not extinguish such rights.

    PTET maintained Pensioner’s rights intact up to the period of 30th June,2010 as per Law and every enhancement in Pension announced by Federal Government implemented in letter and sprit but after 1st July,2010 PTCL unlawfully interfere in the affairs of PTET through Board of Trustees ignoring Dissent Note of the Government Side in the 53rd Board Meeting make plan to put Retired PTCL employees under different categories for the purpose of enhanced Pension payment with effect from 01-07-2010 and kept the amount of withheld Pension for a period of more than 7 months to reap the benefits of interest on the un-paid amount of pension

    That the ambiguity created in 53rd Board Meeting of PTET which raise following question
    1. As to why PTET disbursed enhanced Pension to retired PTCL employees considering them One category from 1st July,1996 to 30th June,2010 and what was the necessity to divide retired transferred employee under different categories in the year 2011. Does law permit for such division?
    2. Whether employees transferred in the year 1991 from T&T to PTC and in the year 1996 from PTC to PTCL were not recruited as Government Servant and their terms and condition of service till retirement remain un-changed?
    3. The employees transferred from T&T to PTC defined as ‘departmental employees’ under section 9 of PTC Act.1991 and those who transferred thereafter defined ‘Transferred Employee’ in PTCL on 1st July,1996 under section 36 of Pakistan Telecommunication (Re-Organization) Act,1996. What is the difference of employment in PTCL those who transferred thereafter? Have they got new Employment Contract from PTCL?
    4. Whether employees transferred from PTC to PTCL on 1st July,1996 were given new Contract of employment by the Management of PTCL if so what was the terms and Condition of their service?
    5. Whether condition applied under Section 36 (3) of the Pakistan Telecommunication (Re-Organization) Act,1996 any equivalent cadre wise post offered to the Transferred employee on 1st July,1996 by concerned quarter? Is there any prior written agreement of transferred employee exist/available with PTCL or PTET, if so declare terms and condition?
    6. PTCL started to recruit new employee on Contract after 1st January,1996 why their terms and condition deviated from Transferred Employee?
    7. What is the position of employees who got appointment after 1st January,1996 in PTCL under New Compensation Pay Grade (NCPG), New Terms and condition (NTC) and Transferred Employee are equivalent? Are their services are pensionable or pensionary benefits are guaranteed by Federal Government like Transferred Employee ?
    8. Whether NTC/Contractual/NCPG employees are entitled to get Pension/Gratuity after retirement from PTET, if not which department is responsible for Compensation of service benefits and what is its nature?
    9. What is the reason of litigation between PTCL and EOBI and claim for payment of Company’s and employees contribution amounting to Rs.1,496,829 thousand for the period from 1st January,1996 to 31st May,2005 as reported in PTCL Annual Report 2010 at page No.108 Notes 16.3 of the Consolidated Financial Statements?
    10. Who are the employees to whom claim is pending towards EOBI?
    11. What is the legal position of transferred employees of PTCL at present?
    12. Whether approved funded pension plan operate through PTET exclusively meant for employees recruited prior to January,1996 and remained as transferred employees in PTCL? Can it be divided/categories further
    13. Whether unfunded pension scheme operates by PTCL for employees recruited on a regular basis on or after January,1996? Can transferred employee be included under this category ?
    14. Can PTCL alter protected terms & condition of service of transferred employees and under what law?
    15. As to why PTCL did not contribute Pension share of retired PTCL employees. As per PTCL Statement of Financial Position as at June,30,2010 shown Non-current Liabilities under Employees retirement benefits as Rs.15,512,803 thounsands refer page No.38 and Note 9 at Page 52 of PTCL Annual Report 2010
    16. What future welfare plan PTET has devised for retired employees and what benefit extended towards children’s education of PTCL retired employees as was provided during service?
    17. Why PTET has engaged employees of PTCL in his own Organization (their names and designation available on PTET Web site)? Are PTET & PTCL are the same Organization? Why PTET has not provided employment opportunity to Retired Transferred employee being a beneficiary?

    Refer page 49 of PTCL Annual Report 2010 it is mentioned that PTCL operates various retirement/post retirement benefit schemes. The Plans are generally funded through payments determined by periodic actuarial calculations or up to the limits allowed in the Income Tax Ordinance,2001. The Company has constituted both defined contribution and defined benefits plans.
    At page No.50 Defined benefit plans see Note No.5.21 (b) (i) (ii) “The Company operates an approved funded pension plan through a separate Trust called PTET for its employees recruited prior to January,01,1996 when the Company took over the business from PTC. The Company also operates an unfunded Pension Scheme for employees recruited on a regular basis on or after January,01,1996 who are the Regular Employee? Was Transferred Employees recruited in PTCL on or after January,1996.
    (ii) Gratuity plan “The Company operates an unfunded and un-approved gratuity plan for its New Terms and conditions (NTC)/ contractual employees.
    PRAYER
    From the explanation given above it is crystal clear that award of pension to the extent of 8% to those Pensioner recruited in T&T and PTC and transferred to PTCL on 1st July,1996 completed their tenure of service under the same terms and condition and retired were entitled for Pensionary benefits in accordance with the Federal Government’s Notification of 5th July,2010.

    ‘Transferred Employees’ were forcefully push to a Company which came into existence under the Companies Ordinance 1984 on 01-07-1996 and their terms and condition of service set forth under Pakistan Telecommunication (Re-Organization) Act.1996. Neither the ‘transferred employees’ were offered any new employment contract by the Company till their retirement, nor equivalent Cadre wise post offered to them in other Organization therefore they were compelled to serve a Limited Company as per terms and condition with the guarantee of Pensionary benefits assumed by Federal Government.

    The PTCL has only to contribute funds to the extent of entitlement of Pensioners and have no authority under any law to curtailed pensionary benefits of retired transferred employee.
    PTET has only role to receive contribution from PTCL manage and disbursed it to pensioner as per their entitlement. They have no authority to divide pensioner into different categories and curtailed Pension of the transferred employee on the basis of their service in PTCL after 1st July,1996 whereas law is very clear on this issue their status in PTC defined ‘departmental employee’ and ‘transferred employee’ in PTCL and there exist no direct employment contract between the transferred employee and PTCL as such Categorizations for the purpose of enhanced Pensionary benefits is unlawful.

    It is therefore requested to set aside the order passed in 53rd Board meeting of PTET and restore Pensionary benefits immediately in accordance with the Federal Government Notification of 5th July,2010
    An early action in the matter is requested please.

    ISLAMABAD, Feb 9 (APP) – Dr.Abdul Hafeez Sheikh, Federal Minister for Privatization during Musharraf era will brief in camera the National Assembly Standing Committee on Information Technology and Telecommunication regarding the Privatization of PTCL on Thursday. The committee meeting will be held under the chairmanship of MNA Ch. Muhammad Barjees Tahir at Parliament House. It would discuss the privatization of Pakistan Telecommunication Company Limited (PTCL) at its meeting, APP learnt on Wednesday.
    The committee will also discuss another issue which is related to the performance of Electronic Government Directorate (EGD).
    The EGD was established in pursuance to a decision of the federal cabinet. Converting the former Information Technology Commission, the Government formed the EGD as a cell within the Ministry of Information Technology.
    Response of Pakistan Telecommunication Employees Trust (PTET) regarding increase in pension and medical allowance of retired employees of PTCL would be also discussed at the meeting.
    PTET was established in January 1996 under the provisions of “the Pakistan Telecommunication (Re-organization) Act 1996” and is controlled by a Board of Trustees.he day-to-day administration of the Trust is assigned to the Managing Director.
    The task of PTET is to manage the pension payments to erstwhile T&T and PTC pensioners. Currently over 39,000 pensioners draw pension through Post Offices.

PTCL Senior citizen have agitated against injustice faced for last 7 months but not noticed by the any Govt authorities and not seen any Govt. involved in this matter. Govt. in Pakistan is busy in protecting their positions to work against the people rights and that’s why all the society is protesting against them for their rights. Protest and presence of PTCL pensioners including orphans and widows when come on street is also their right. Be sympathetic to the pensioners and not lords of democratic dictators who should aware of Tunis and egypt. Zulm Hadd se barh gia he………….

I THINK PTCL HAS THEIR OWN RESERVATIONS IN INCREASING PENSION OF VSS EMPLOYEES, BUT WHILE MAKING DECISION THEY SHOULD KEEP IN MIND THAT INFLATION IS AT ITS HIGHEST LEVEL AND ALL THE VSS EMPLOYEES HAD RENDERED TREMENDOUS SERVICES FOR PTCL. THEY DON HAVE ANYTHING EXCEPT PENSION FROM PTCL. ETISALAT IS A GOOD MULTINATIONAL COMPANY, THEY COULD NOT EXERCISE DISCRIMINATION WITH THEIR RETIRED EMPLOYEES. MAY THE SAID NOTIFICATION BE ISSUED WITH SOME ERROR, THEREFORE, THEY SHOULD CORRECT IT SO THAT THEY CAN AVOID ” BAD PRAYERS” OF THOUSANDS OF RETIRED EMPLOYEES.

    well commented Ayaz Cheema Sb.,I already posted here that the high-ups do not have the feeling that they will be like us in near futur.Even there are some people at key slots in PTCL are also pensioners but they do think of contract money and monthly T.A/D.A alongwith other benifites which cannot be disclosed.Even more the retired PTCL officers are not interested to agitate because the are “VENDORS” of the company and earn huge amounts.Only Allah Almighty will help us otherwise politicians,media and government are not interested to take notice of it or even admitting it.

    There may be philosophical debate about the increase in pension made by the PTCL management.I do believe when some one has right to make decision when he in hot seat he is primarily and by nature “SELFISH”. The way we have brought up and taught leads to the situation that we have no concern for the values of others. The management has no concern how the pensioners are fulfilling their deeds of household. We only can hope that May God improve their social behavior.The dual character of their social behavior needs actually an learning and thinking i.e. They value fairness & justice in their real sense.I have come to conclusion that this SELFISHNESS is the greatest social disease of our society. On the day of judgment they will have to answer of their discrimination. I would like to add a well known saying of Mother Teresa “One of the greatest diseases is to be nobody to anybody.” and for the same situation some poet has rightly said. YA TO DUKH SUKH BANT KAY KHAO WARNA CHAMAN KI BAT HE CHORO, YE KESA INSAF HAY JIS MEIN SARY PHOOL TUMHARY HOON”
