Current Status PTCL Pensioners Issue – Written By Naseem A. Vohra
A good number of Pensioners have contacted me, as Secretary General TPA, to inquire about the factual status of Pension Case in the face of a number of SMS/emails etc. Quite a number of questions have been asked; such as
1. what are the implications of the recent Judgment announced by Honorable Double Bench of Islamabad High Court,
2. will all the pensioners get their legitimate pension now ?
3. what is future strategy of TPA ?
4. when will all the pensioners get their legitimate/entitled pension etc. etc.
TPA has been silent for a considerable period now for the simple reason that Ministry of IT, guarantor of our rights, was hiding behind the Court Case and there was no hope of for them to come forward to alleviate the problems of the pensioners–Ministry was not bothered. No sit-ins/protests bothered the Government of the day. Only hope for the pensioners was –Court Decision.
By the grace of God Almighty truth has prevailed through the efforts of pensioners who had filed Writ Petitions in Islamabad High Court and secured initial decision on 21st Dec. 2011 and then went on to defend the Appeal filed by PTCL/PTET.
The petitioners in Islamabad High Court have worked very hard to secure the initial decision, we must acknowledge their efforts collectively since it is only these petitioners who have succeeded in securing the decision although a number of Writ Petitions have been filed in various High Courts across the country. The petitioners went on to defend the Appeal successfully and secured the Judgment announced by Double Bench of Islamabad High Court on 17th March 2014.

Let us acknowledge special efforts of Mr. Muhammad Arif and associates , who had moved a Contempt of Court case for non payment of entitled pension immediately after securing a favorable decision in 2011.
PTCL/PTET filed an Intra-Court Appeal in IHC against the Contempt proceedings and secured a stay order which was dismissed by the Islamabad High Court on 17th March 2014 alongwith dismissal of original ICA against the order to pay entitled pension to Petitioners.
IHC has now started Contempt Proceedings against PTET etc. PTCL/PTET will have to pay entitled pension to petitioners or file Appeal in Supreme Court of Pakistan immediately.
TPA takes pride in supporting Mr. Muhammad Arif and Mr. Muhammad Anwar Shahid technically and financially from the contribution you made to TPA for this very purpose. TPA again takes pride in not wasting money you contributed enthusiastically. We are grateful to you for your faith in TPA.
Let us not forget that the original Judgment of Islamabad High Court directs PTET to pay pension to Petitioners including pensionary benefits notified by the Government alongwith arrears. Although the Judgment sets principals where the increases are admissible to all ex T&T employees, PTCL/PTET is not expected to follow the principals/rationality.
We should not lose sight of our basic objective in being over enthusiastic — to secure entitled pension for all the pensioners– 39000 of them
TPA discussed the whole issue threadbare in its meeting held on 22nd March 2014 and devised future strategy. TPA concluded with hope for the best and decided to prepare for the worst.
As first step TPA decided to write a letter to Secretary IT (Copy attached for information) with the hope that Contempt Case will do it for all pensioners. TPA believes that with so many judgments announced by Supreme Court of Pakistan in favour of Telecommunication Employees there is little chance that PTET/PTCL can get their Appeal filed in Supreme Court.
Preparing for worst case scenario TPA requests you to brace for more sacrifices–contributions, if need be. Presently TPA has enough money left from your previous contributions to meet emergencies; however may need more contribution to persue the case in Supreme Court.
In all cases TPA will fight for securing entitled pension for ALL Pensioners whether members of TPA or not.
TPA will issue a separate call for contributions, if need be, with strong belief that all of you will contribute for achievement of our objective–Entitled Pension for All Pensioners.
