EOBI Pension Status of PTCL Employees Retired in 2008 VSS

Dear T&T, PTC and PTCL Pensioners
Assalam o Alaikum
The PTCL Management has registered their all the employees with M/S EOBI and get them issued EOBI Card for giving benefit after the age of 60 years. But the employees retired in year 2008 under VSS were ignored and not registered with EOBI. Due to this reason all the pensioners 2008 to 2012 (prior second VSS) could not benefited from this scheme. The EOBI demanded contribution of all retired employees since 1996 the PTCL management refused and approached to the Court.
I have approached to EOBI authorities to conform our status (retirees of 2008) . In this regard the Director Law EOBI confirmed through Email and on phone that we the retiree are entitled for EOBI benefits as per law.
At present this case is pending the Supreme Court of Pakistan.

Dear Taj Muhammad
Your kind is drawn that M/S PTCL is registered with EOBI from 1996 and accordingly contributions were paid by them in respect of employees who were in their employment but no contributions were paid in respect of those employees who have been retired and were not in their employment at the time of payment. A dispute has been created between M/S PTCL and EOBI on some legal issues including the aforesaid question as M/S PTCL is liable to pay contributions in respect of all employees in their employment from 1996 to onward. The litigation between both parties has reached to the Supreme Court for final verdict, wherein the matter is pending. After the final judgment of the Honorable Supreme Court on the issue, the contributions shall be recovered accordingly and claims of all employees who were in the employment on the date of registration to onward shall be processed and benefits shall be awarded in accordance with law.

Please refer to e.mail of Mr. Taj Muhammad, a retired employee of M/S PTCL who has raised a query regarding the registration of employees retired from 1.1.1996 to 2011 after change of status of the company from statutory to Private Limited company. It is submitted that M/S PTC was not registrable under the scheme being a statutory body and the employees of this company were exempted from the purview of the EOB Act, 1976 under section 47 (f) ibid.Immediately after its registration as limited company and conversion of status, the employees of M/S PTCL came under the purview of the scheme and contributions on the prevalent rate is payable by the company extending due benefits to all the employees under its employment.

Dear Sir,
The PAKISTAN TELECOMMUNICATION COMPANY LIMITED has been registered as a PRIVATE Company from Government and obtain a certificate from the competent authority as private company. During the last few years the company got their employees registered with the EOBI and paid all contribution and employees were issued EOBI Card. The employees retired from 01-01-1996 onward probably up to the year 2011 were also entitled for this scheme being company employees as per Government / EOBI rules but the PTCL management either got registered these employees nor paid their due contribution to EOBI.
In this kindly confirm that either these ex-employees were entitled for registration with EOBI or not. This situation has might caused contribution losses to EOBI and financial benefits to all EX-employees and also create an anomaly between present and Ex-Employees.
