Learned counsel appearing for PTCL separately filed miscellaneous application eeking
modification of order dated 14.9.2012 and drawn my attention towards a portion of said order. While passing the said order respondents were required to submit their reply within a period of fifteen days else appear in person before the Court. Learned counsel for the petitioner has not moved instant CM on behalf of PTCL being incompetent person who has no authority to submit reply on behalf of respondent in criminal original but submit a separate CM for modification of order dated 14.9.2012. To the
extent of portion of order dated 14.9.2012 when an application moved by learned counsel for the Debboner, a general written order was passed.
PTCL has an authority to agitate by making a separate CM, therefore, this CM entertained by this Court. While entertaining the CM moved by the official of PTCL, this Court vide order dated 20.9.2012 clarified the position that the authorities have to confine themselves only to the extent of sub-section 13 of section 19 IRA 2012 which is in fact the sense of the original order now passed in the instant criminal original i.e order dated 27.6.2012. The said order speaks that no adverse action shall be initiated against any of the employee or office bearer of trade union does not include all the employees of PTCL. Therefore, vide order dated 20.9.2012 whereby clouds created over entire proceedings initiated from its commencement is removed. Hence, instant CM in view of clarification vide order dated 20.9.2012 stands disposed off. The respondents since have not submitted their reply to the directions vide order dated 14.9.2012,
therefore, they shall appear in person on 16.10.2012 as they were required to submit their reply within fifteen days which they have not filed.
