Lahore High Court Ordered to Implement PTCL Cases within a Month (Copy of Judgement)

Lahore (Friday, 2 September 2016) – Order passed by Lahore High Court Honourable Chief Justice Mr. Justice Syed Mansoor Ali Shah in a Writ Petition#25713-16 filed by Pakistan Telecom Lines Staff Union.
The Court ordered to implement 2012 SCMR 152 (Masood Bhatti Case) within one month.

MAIN CASE.
2. Submits that the petitioners are erstwhile employees of Telephone and Telegraph Department of the Federal Government which later on became Pakistan Telecommunication Corporation Limited (“PTCL”). It is submitted that in the light of the judgment of the august Supreme Court of Pakistan reported as Masood Ahmed Bhatti and others v. Federation of Pakistan through Secretary M/0 Information Technologv and Telecommunication and others (2012 SCMR 152) read with order dated 19.02.2016 passed in Civil Review Petition Nos.247 to 249 of 2011 in Civil Appeals No.239 to 241 3/2011, the terms and conditions of service of the petitioners as settled in Telephone and Telegraph Manual issued by the Telephone and Telegraph Department Government of Pakistan and the notifications issued thereunder stand protected and the said benefi. have to be extended to the petitioners. It is submitted that the application which was dispatched to PTCL on 02.06.2016 but there has been no progress in the matter.

3. Before proceeding further in the matter, PTCL is directed to decide the aforementioned application of the petitioners (at page 46 of the petition) within a period of one month the receipt of this order and place a copy of the decision on the record before the next date of hearing.

4. To come up on 04.10.2016. C.M.No 1/2016

5. Dispensation prayed for is allowed subject to all just and legal exceptions.
