Court reinstates PTCL contract employees
In PESHAWAR the Peshawar High Court on Wednesday reinstated 95 employees of Pakistan Telecommunication Company Limited by declaring their termination as illegal.
A two-member bench comprising Chief Justice Ejaz Afzal Khan and Justice Mazhar Alam Miankhel observed that the Telecom Foundation (TF) had no authority to order termination of services of those employees.
The bench allowed six writ petitions jointly filed by around 95 of the terminated employees, which also included some females.Advocate Ijaz Khan Sabi and Salahuddin Khan appeared for the petitioners and argued that the workers were appointed on contract basis on different dates during 1999 and 2000 for a period of 189 days. He added that subsequently their tenure of service was extended from time to time.
The counsel stated that in 2006 and 2007 the TF ordered the termination of their services. He argued that the TF was a trust set up for the wellbeing of the serving and retired employees of Pakistan Telecommunication Company Limited and its subsidiaries included Pakistan Telecom Authority, National Telecom Corporation and Frequency Allocation Board.

Court sets aside sacking of 95 PTCL employees
Peshawar High Court (PHC) on Wednesday allowed the petition of 95 employees of the Pakistan Telecommunication Company Limited (PTCL) who had challenged the termination of their services.
A division bench of the PHC comprising Chief Justice Ejaz Afzal Khan and Justice Mazhar Alam Miankhel restored them to their old positions in the company. The court was hearing the petition filed by 95 employees of the PTCL, whose services were terminated, through Ejaz Sabir advocate.
The petitioners stated that their services were unlawfully terminated from. The counsel argued that his clients were working in the company as contract employees since 1999. In 2006, he said, the PTCL and Telecom Foundation signed an agreement under which all the employees were shifted to the Telecom Foundation, which terminated the services of all of them the same year. “The Telecom Foundation had no authority to terminate them from their jobs as they were the employees of PTCL,” he contended.

Fayaz Afzal and other 94 terminated employees working on different positions including wireman, cable guards, drivers and computer operators, had filed a writ petition in the high court through Ejaz Sabi advocate praying the court to restore them as they were unlawfully terminated from their jobs. Counsel for the petitioners contended that these PTCL contract employees were working in the company since 1999. In 2006, he said, PTCL and Telecom Foundation had signed an agreement under which all these employees were given to Telecom Foundation. He said that the Telecom Foundation then terminated all the employees in 2006. The petitioners’ lawyer told the court that Telecom Foundation had no authority to terminate them from their jobs as they were the employees of the PTCL. He said that the Telecom Foundation’s termination order was unlawful and thus be set aside. After hearing of the case, the bench declared the employees’ termination order as void and directed the PTCL to reinstate the employees on their old positions in the company.

    I am the employee of National Trust for Population Welfare (NATPOW) since 1992 and I was unlawfully terminated due to my only fault that being as an Administration and Personnel Officer, that denied frequently the CEO NATPOW illegal orders i.e. official vehicles with fuel drive faciltiy for former Minister of Population Welfare (PW) now Minister of Information, besides my request for action taking against fake degree holders and employee involved in fuel scandel further CEO also pressurised me to to re surface again the demoted officers cases to bring back to orginal positions besides official vehicle theft cases for further relief. In addition to above the CEO back door endorsement through previous NATPOW BOD etc.The previous BOD was terminated before three tenor who showed conecern on his back door eneternce at NATPOW with huge monthly package etc So it was my fault which was considered as a misconduct and in return, I was terminated without proper inquiry and show cause notice of NATPOW unbreakable and unblemished 18 yera’s service with contract of indefinte period. Apart from above, I have also deprived prior and after termination of hearing facility to defend my self. In this reagrd several request were submitted before respondants for establsihing indepdent Inquiry Committee to consists of neutral and honest officers from NATPOW or out soide organization tyo conduct impartial inquiry to recommend finding against any one like CEO or Admin & Personnel offoicer(me) for further action without any one status or political affiliation with the prsent Government.. Now I have filed a writ Petitione against the unlawfull termination against the respondants before Chief Justice Islamabad high Court Islamabad for provision of justice. It is requested to all viewre and readers that project my case at all social forum that the same opportunity I am also iThanks!!

    I was employee in PTCL(OFC) Lahore reagon from Aug 2002 to Oct 2007 and unfortunatly I was terminated in oct 2007.After the above High court(Peshawer)decioun what should i do???
    Kindly suggest me and provide your precious opinions….
