The court observed that the Pakistan Telecommunication Authority (PTA) has awarded the licence to cellular companies for providing telecommunication services to consumers and they can only earn profit by offering communication service to their subscribers, not by introducing prize schemes.

The PTA on May 28, 2012 had instructed all telecommunication service providers to stop all award systems, prizes even if they are genuine. All the cellular phone companies then challenged the said directions before the court last year in June.

Afnan Karim Kundi, PTA counsel, told the court that the Supreme Court also discouraged such prize schemes. While counsel for the cellular companies argued before the court his clients had been doing their legitimate business and introduction of prize schemes was not violation of the consumer rights.

An IHC bench after initial hearing had issued a stay order in favour of cellular companies but finally dismissed their petitions after the counsels of the companies and the PTA concluded their arguments.
