PTET decided to file appeal against IHC decision of PTCL Pensioners
Islamabad (Breaking News, Tuesday, January 10, 2012) – Pakistan Telecommunication Employees Trust (PTET) Board of Trustees meeting held in Islamabad today. It is decided to file appeal against Islamabad High Court historical judgement of PTCL pensioners dated December 21, 2011.

WHAT I EXPECT FROM PTET? TRUE TO THE BEST OF MY SENSE. I ADVICE TO PTET REVIEW THEIR BOT 10.01.2012 DECISION. IN WHICH FACE BOT DECIDED TO FILE APPEAL AGAINST IHC DECISION. ONLY DELAY TACTICS. SUPREME COURT OF PAKISTAN DECISION IN THIS CONCERNING MATTER ALREADY ON THE RECORD.
PTET ENEMY OF THE PTCL PENSIONERS NOT PLAY THEIR ROLE IN THE INTEREST & WELFARE OF PENSIOENRS, THEIR IN ALSO PARTICIPATION OF PENSIONERS AS A MEMBER.

Don’t worry, Inshallah we will succeeded as the Supereme Court does not spare Government, PTET is no weight as compare to Government. I fully trust on Al-mighty Allah, Supereme Court will decide in our favour with profit.

We are all very well know that the Filing of appeal from PTET is ONLY DELAY TACTICS. Supereme Court of Pakistan already have their judgement about the matter for ENHANCEMENT / INCREASE IN PENSION W.E.F. 01-07-2010. They have already given directives to PTET / PTCL for implementation of their judgement.
It is time for pensioners associations to become a party to the case, so that a clear verdict for all pensioners is obtained without any ambiguity.

The Almighty God Says in Holy Quran ” Fasayak fee kahumullah ” Allah Hamaray saath hay.Is main bhi hamari bhalaee ho gee. Allah kay pas dair hay andher nahin. Allah insaf karnay wala hay. Allah Munsif (Insaf karnay walla) bhi hay, hakeem (hikmat walla)bhi hay aur baseer (dekhnay walla) bhi hay.
AOA to all PTCL pensioners. PTET was created by the hon”able Parliament of Pakistan, but it seems PTET does not suppose itself answerable to the Govt./Parliament, as the increase in pension in budgets 2010-2011 & 2011-2012 has not been implemented and at the same time Standing committee’s orders in this regard also ignored. Is there any authority in the Govt. above the Trust who direct it to abstain from going in the appeal and implement the hon”able Parliament and the hon”able IHC decisions.
Dear Fazal Ali and Mirza Riaz Baig, I appreciate your’s struggles and hopes of Fazal Sahib,I fully agree with the suggestion of Mirza sahib to Make close contact with active pensioners throughout the country, i mean (Association) of ptcl pensioners for collection of fund rising,and support to the petitioners of IHC.to engage well known Advocate for fighting the case to get the result with in a short period of time.Allah is Great he will help the pensioners,widows,orphens etc.inshallah we will succeed.keep it up.
Following points are suggested in the current situation’s perspective:
a. A representative meeting from across the country is convened preferably in Islamabad to chalk out a multi dimensional strategy for facing the upcoming situation in the court and outside.
b. All the Associations and active members of PTCL Pensioners community must sit together and form a FEDERATION or even a new registered platform to defend the rights of the pensioners.TPA (Telecom Pensioners Association) mainly consist of Islamabad representatives.PTPT (Pakistan Telecom Pensioners Trust)mostly contain Karachi/Sind members.Quaid Welfare Society consist of Lahore based Pensioners/Pensioners representatives and Pakistan Retired Employees Association is KPK based association(Although exceptions may be there).
c. A truly representative platform from across the country be established if we fail to form a Federation of these Associations. A Steering Committee in case of federation be formed to chalk out a unanimous strategy to face all upcoming situations and a fund raising campaign be initiated through these members of the Committee belonging to all parts of the country.
d. A well reputed and competent lawyer be engaged to defend our case in the courts.
e. Other issues relating to pensioners may be discussed at this proposed platform.
This is yet another opportunity for us to be united and safeguard our rights. The GoP,PTET,PTCL and Royal families of Pakistan and U.A.E are united at this stage against us and we can only defend/capture our rights if we get united otherwise we may face more severe actions from our enemies.

I AGREE WITH MR.TAUQEER REMARKS.
PTCL ALREADY GONE IN SUPREME COURT FOR THE REVISION OF PREVIOUS CASE. IF REVISION OF PREVIOUS CASE EXIST IN SUPREME COURT THEN WHAT IS THE NEED OF APPEAL AGAINST THE IHC DECISION ON SAME LINES.
HOWEVER PTCL HAS SUFFICIENT FUNDS TO DISTRIBUTE TO ADVOCATES, BUT THEY ARE NOT RELEASING FUNDS FOR POOR PENSIONERS.
REALITY IS THAT THERE IS NO LAW IN THIS COUNTRY FOR THE PROTECTION OF POOR CLASSES.
Fully agreed with Mr.Tauqeer.PLease spread this message and step out.It is time for action.

In my opinion this will be the test case for Mr. Iftikhar Chaoudhry CJ of Supreme Court as there is interest of 40000 retired pensioners involved. This case doesn’t belong to any political personality or NRO. In view of the judgement of SC/IHC in favor of PTCL pensioners appeal must be rejected by Registrar. How dare PTET is playing game in the interest of PTCL, the three Directors belongs to government must be sacked.

I pray to Almighty Allah to help all of us.Then I pray for the sucess of the petioners in Islamabad High Court who convincingly fighted their case and ultimnately won.The Honourable Chief Justice of Islamabad High Court is also to be saluted for his historic judgement.I hope Insha Allah we will also be victorious in Supreme Court of Pakistan.
In my opinion a writ pettition against those officers be filed who are misguiding the higher up just for their own interets.And benifits may be claimed with depericiation value (recovered by the Corrupt Officers) and a examplary actions against them who are continously misguiding top mamagement.
Also a case should be filed in NAB against the embazzelement in construction of PTET Tower.

Para 26 is very important. The Court has observed breach of trust on the part of trustees. Trustees who are employees of the company have been found looking after the interests of the company giving favor and nepotism.
Now these associations should on first attempt to remove these trust should move court to appoint trustees under Trust Act 1882. The beneficiaries have right to move court.
The composition of board of trusties is in conflict and a cause of abuse of process of law.

BUT IT IS MENTIONED IN THE 1996 TELECOM.REORGONIZATION ACT THAT THREE MEMBERS FROM PTCL & THREE FROM GOVT.
In my opinion the appeal will be rejected as SC has already clarified the ptcl employees as transferred employees and their rights of pension and other will remain the same as on appointment except appointed by the company after 1996.The Standing committee’s orders and IHC decision are clear in favor of Employees.It is the time to unite and the suggestion by Tuqeer & Mirza Raiz Baig are to be considered for defend pensions rights and razing funds with personal contacts with pensioners.

What about the hearing of 25th Jan 2012 in islamabad high court, can any one tell me? I think ptet/ptcl both want to prolong the case,that is why they engeged Mr eitezaz hassan to fight the case against poor ptcl pensioners/widows/orphans,it is very sad, But i have hope by the grace of God he will help us,but continous struggle is essential,keep it up.

Dear Pensioners our case is now in critical stage.If it is not fought well we all have to bear irrepairable loss in future.PTET/PTCL will decide all the matters at his own will.We all know they have ever ill will against the pensioners.
In my opinion till yet every one of us is facing financial loss(Due to non implementation of Government Orders) at 10000/= each and calculate it how it will be infuture.

AND SENATOR ISHAQ DAR but yet not any result lat hearing of case is to day
25th case proceed but once again it will be delayed till second week of MAY.
Tariq bhai this critical situation we are facing since JULY 2010 no any decision
came by IBA COURT looking this in future our families eat meal by the permission
of such courts who are working on JUSTICE DELAY JUSTICE DENIED.

WRIT PETITION No.148 of 2011
In view of circumstances enumerated above, all the above mentioned four constitutional petitions are accepted in the terms that Pakistan Telecommunication Employees Trust is directed to pay the pension etc. to the petitioners according to increase made by the Government along with arrears if any.
